2. Scope of These Terms
These Terms apply primarily to use of LADFAH websites and generally available digital resources. Certain LADFAH products, subscriptions, implementations, professional services, hosted environments, or enterprise platforms may be governed by separate agreements.
If a signed commercial agreement conflicts with these Terms regarding a specific LADFAH service, the signed agreement will generally control for that service.
3. Eligibility and Authority
You may use LADFAH Services only if you are legally permitted to do so. If you access LADFAH on behalf of a company, organization, government entity, or other legal entity, you represent that you are authorized to act on its behalf where such authority is required.
4. Permitted Use
You may use LADFAH websites and Services for legitimate professional, commercial, technical, research, engineering, evaluation, procurement, support, or informational purposes. Your use must comply with applicable laws, these Terms, the LADFAH Acceptable Use Policy, and any contractual obligations applicable to your organization.
5. Accounts and Access Credentials
Some LADFAH Services may require an account. You are responsible for maintaining the confidentiality of your login credentials and for activities performed through your account.
You should notify LADFAH promptly if you believe that your account, password, API credential, authentication token, or access mechanism has been compromised.
6. Demonstrations and Evaluations
LADFAH may provide demonstrations, trials, previews, proof-of-concept environments, evaluation access, or pre-release functionality. Such functionality may be limited in availability, subject to change, provided without production-level guarantees, or withdrawn or modified at LADFAH’s discretion.
Evaluation environments should not be relied upon for production or safety-critical operations unless explicitly authorized in writing.
7. Intellectual Property
The Services and associated materials may include LADFAH software, interfaces, designs, dashboards, documentation, models, algorithms, workflows, graphics, logos, trademarks, text, data structures, and other proprietary materials. Except where expressly stated otherwise, these materials are owned by or licensed to LADFAH and are protected by applicable intellectual-property laws.
8. LADFAH Trademarks
The LADFAH name, logos, product names, visual identity, and related marks are trademarks or identifying marks of LADFAH. Nothing in these Terms grants permission to use LADFAH branding in a manner that suggests sponsorship, endorsement, partnership, or affiliation without authorization.
9. User-Submitted Information
You may provide information to LADFAH through forms, technical-demo requests, support requests, project inquiries, uploads, communications, or authorized platform functionality. You represent that you have the right to provide such information.
Do not submit passwords, private keys, authentication secrets, or similar security credentials through general contact or inquiry forms.
10. Customer Data
Where LADFAH software processes data on behalf of an enterprise customer, ownership and permitted use of such data may be governed by the applicable customer agreement. LADFAH does not claim ownership of customer business data merely because it is processed through a LADFAH platform, except for rights expressly granted under an applicable agreement.
11. Artificial Intelligence and Analytics
LADFAH Services may provide artificial intelligence, predictive analytics, automation, classification, computer vision, engineering calculations, recommendations, or other algorithmic outputs. Such outputs may assist professional decision-making but should be evaluated in the context of the relevant operation.
Unless expressly agreed otherwise, LADFAH outputs do not replace qualified engineering judgment, professional review, safety procedures, regulatory obligations, manufacturer requirements, or required human authorization.
12. Engineering and Operational Information
Information presented through LADFAH websites, demonstrations, dashboards, case studies, visualizations, examples, or marketing materials may be illustrative. Operational performance depends on many factors, including data quality, equipment condition, field conditions, deployment architecture, workflows, configuration, and user decisions.
Illustrative metrics should not be interpreted as guaranteed outcomes unless expressly stated in a binding agreement.
13. Third-Party Services
LADFAH Services may integrate with or link to third-party systems, applications, APIs, websites, infrastructure, datasets, or services. Third-party services are governed by their own terms and privacy practices.
14. Availability and Changes
LADFAH may update, improve, modify, discontinue, or replace website content or generally available features. Service-level obligations for enterprise customers, if applicable, are governed by the relevant commercial agreement.
15. Cybersecurity
You must not attempt to compromise LADFAH systems or circumvent access controls. Security testing, penetration testing, vulnerability scanning, or similar activity against LADFAH infrastructure requires prior written authorization unless applicable law provides otherwise.
Suspected vulnerabilities may be reported to [security@ladfah.com].
16. Acceptable Use
Use of LADFAH Services is also subject to the LADFAH Acceptable Use Policy. Violation of that policy may result in restricted or suspended access.
17. Privacy
LADFAH’s collection and handling of personal information is described in the LADFAH Privacy Policy. Where cookies or similar technologies are used, additional information may be provided through the LADFAH Cookie Policy and applicable cookie controls.
18. Disclaimers
To the extent permitted by law, publicly available LADFAH websites and informational materials are provided on an “as available” basis. LADFAH does not warrant that all website information will be complete, continuously available, or free from errors.
Nothing on the public LADFAH website should be interpreted as engineering, legal, financial, safety, or regulatory advice for a specific operation unless expressly provided as part of an authorized professional engagement.
19. Limitation of Liability
To the maximum extent permitted by applicable law, LADFAH will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from use of publicly available website content. Any limitations applicable to paid software, enterprise services, professional services, or customer deployments will be governed by the applicable commercial agreement.
20. Indemnification
Where permitted by applicable law, you agree to be responsible for losses arising from your unlawful use of LADFAH Services or material violation of these Terms. Enterprise indemnification obligations, if any, will be governed by the applicable written agreement.
21. Suspension or Termination
LADFAH may restrict or terminate access to publicly available or authenticated Services where reasonably necessary because of security concerns, unlawful activity, material violations of these Terms, misuse of Services, or contractual termination.
22. Export Controls and Sanctions
You are responsible for complying with applicable export-control, sanctions, trade, and restricted-party laws associated with your use of LADFAH Services.
23. Governing Law
These Terms will be governed by the laws of the United Arab Emirates and the local laws and decrees of the Emirate of Ajman, without regard to conflict-of-law rules, unless otherwise required by applicable law or agreed in writing.
